Blue Valley Junk, LLC ("Blue Valley Junk," "we," "us," or "our") is committed to protecting the privacy of our users. This Privacy Policy describes how we collect, use, disclose, store, and protect your personal information when you access or use the Blue Valley Junk website, mobile application, and marketplace platform at bluevalleyjunk.com (collectively, the "Platform"). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Platform.
Personal Information You Provide
When you create an account, use the Platform, or communicate with us, we may collect the following personal information: (a) full legal name, display name, and username; (b) email address and phone number; (c) physical address, city, state, and zip code; (d) profile photographs and avatar images; (e) payment and billing information (processed and stored by Stripe, our third-party payment processor); (f) for Haulers: business name, business address, business license information, insurance documentation, service area details, equipment information, Employer Identification Number (EIN) or Social Security Number (SSN) for tax reporting purposes, and Stripe Connect account information; (g) job listing details, including descriptions of items to be removed, property addresses, photographs, and scheduling preferences; (h) communications between users, including messages, bids, and dispute documentation; (i) reviews, ratings, and feedback you submit; and (j) any other information you voluntarily provide to us.
Information Collected Automatically
When you access or use the Platform, we automatically collect certain information, including: (a) device information, such as device type, operating system, browser type and version, device identifiers, and screen resolution; (b) usage data, including pages visited, features used, links clicked, search queries, time spent on pages, and interaction patterns; (c) IP address and approximate geographic location derived from your IP address; (d) referral URLs and the website or source that directed you to the Platform; (e) date and time of access, session duration, and frequency of visits; and (f) cookies, pixel tags, web beacons, and similar tracking technologies (see Section 6 below).
Location Data
We collect location information in several ways: (a) addresses you provide for job listings, service areas, and account profiles; (b) approximate location derived from your IP address; and (c) precise geolocation data from your mobile device or browser if you grant permission. You may disable location services through your device settings, but this may limit certain features of the Platform.
We use the information we collect for the following purposes: (a) to operate, maintain, improve, and personalize the Platform and our services; (b) to create and manage your account; (c) to connect Customers with Haulers and facilitate transactions; (d) to process payments, commissions, refunds, and escrow transactions through Stripe; (e) to send transactional communications, including booking confirmations, bid notifications, payment notifications, dispute updates, and account alerts; (f) to send promotional communications, newsletters, and marketing materials (you may opt out at any time); (g) to respond to your inquiries, comments, feedback, and support requests; (h) to monitor and analyze usage trends, user behavior, and Platform performance; (i) to detect, prevent, and address fraud, security breaches, technical issues, and other harmful or unauthorized activities; (j) to enforce our Terms of Service, Acceptable Use Policy, and other policies; (k) to comply with legal obligations, including tax reporting, subpoenas, court orders, and other legal processes; (l) to protect the rights, property, and safety of Blue Valley Junk, our users, and the public; (m) to conduct research and analytics to improve our services; (n) to generate anonymized, aggregated, or de-identified data for statistical and analytical purposes; and (o) for any other purpose with your consent or as permitted by applicable law.
We may share your information in the following circumstances: (a) with other users as necessary to facilitate transactions (for example, a Customer's job address is shared with the Hauler who accepts the bid, and a Hauler's profile information is visible to Customers); (b) with Stripe for payment processing, identity verification, and fraud prevention; (c) with Cloudinary for image hosting and management; (d) with mapping and geolocation service providers to display locations and calculate service areas; (e) with email service providers and communication platforms to send notifications and communications; (f) with analytics providers to understand usage patterns and improve the Platform; (g) with hosting and infrastructure providers that operate and maintain the Platform; (h) with law enforcement, government agencies, or other third parties when required by law, subpoena, court order, or other legal process, or when we believe disclosure is necessary to protect the rights, property, or safety of Blue Valley Junk, our users, or the public; (i) in connection with a merger, acquisition, sale of assets, bankruptcy, dissolution, or other corporate transaction, in which case your information may be transferred to the acquiring entity; (j) with our attorneys, accountants, auditors, and other professional advisors; (k) with your consent or at your direction; and (l) in anonymized, aggregated, or de-identified form that cannot reasonably be used to identify you.
We do not sell your personal information to third parties for their direct marketing purposes.
We retain your personal information for as long as your account is active, as needed to provide you services, and as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and protect our rights. Specifically: (a) account information is retained for the duration of your active account plus seven (7) years after account closure for legal, tax, and regulatory compliance purposes; (b) transaction records, payment history, and financial data are retained for a minimum of seven (7) years as required by tax and financial regulations; (c) communications, messages, and dispute records are retained for five (5) years after the last activity; (d) usage data and analytics are retained in identifiable form for two (2) years, after which they may be retained in anonymized or aggregated form indefinitely; (e) reviews and ratings may be retained indefinitely, even after account deletion, in anonymized form (with all personally identifiable information removed); and (f) legal hold data is retained as required by applicable legal proceedings or government investigations.
Account Suspension (Disable)
When an account is suspended or disabled by Blue Valley Junk, all personal data associated with the account is retained in full. The account holder's profile is hidden from all public listings, search results, and maps during the suspension period, but no data is deleted. The account may be reinstated by Blue Valley Junk at any time, at which point all data and profile visibility will be restored.
Account Deletion and the 30-Day Grace Period
You may request deletion of your account and associated personal data by contacting us at privacy@bluevalleyjunk.com. When an account deletion is initiated, whether by the account holder or by Blue Valley Junk, the account enters a thirty (30) day grace period. During this grace period: (a) the account holder's profile is completely hidden from all public-facing areas of the Platform; (b) the account holder will be notified via email of the deletion and the scheduled date of permanent deletion; (c) the account may be reinstated during the grace period by contacting support at support@bluevalleyjunk.com or by administrative action; and (d) all personal data remains intact and recoverable. Upon expiration of the thirty (30) day grace period, the account and associated personal data will be permanently deleted, subject to the following retention exceptions: (i) transaction records, payment history, and financial data are retained for a minimum of seven (7) years as required by applicable tax and financial regulations; (ii) reviews and ratings submitted by the deleted account holder are anonymized (with all personally identifiable information removed) and retained on the Platform; (iii) communications and dispute records are retained for five (5) years from the date of last activity; and (iv) any data subject to a legal hold or required to be retained under applicable law, regulation, or court order will be retained for the legally required period. We will process deletion requests and begin the thirty (30) day grace period within a reasonable timeframe of receiving your request.
We implement and maintain reasonable administrative, technical, and physical security measures designed to protect your personal information from unauthorized access, use, alteration, disclosure, and destruction. These measures include but are not limited to: (a) encryption of data in transit using HTTPS/TLS protocols; (b) hashing of passwords using bcrypt or equivalent industry-standard algorithms; (c) secure authentication tokens and session management; (d) regular security assessments and vulnerability testing; (e) access controls and least-privilege principles for personnel who access personal information; (f) secure hosting infrastructure with appropriate physical and environmental safeguards; and (g) incident response and data breach notification procedures. HOWEVER, NO METHOD OF TRANSMISSION OVER THE INTERNET AND NO METHOD OF ELECTRONIC STORAGE IS COMPLETELY SECURE. WE CANNOT AND DO NOT GUARANTEE THE ABSOLUTE SECURITY OF YOUR PERSONAL INFORMATION. Any transmission of personal information is at your own risk. We are not responsible for any circumvention of privacy settings or security measures on the Platform.
We use cookies and similar tracking technologies to operate and improve the Platform. The types of cookies and tracking technologies we use include: (a) essential cookies that are necessary for the Platform to function, including authentication, session management, and security cookies; (b) analytics cookies that help us understand how users interact with the Platform, including page views, navigation patterns, and feature usage; (c) preference cookies that remember your settings, preferences, and choices; and (d) third-party cookies set by our service providers, including Stripe (for payment security and fraud prevention) and analytics providers. You can control cookies through your browser settings and may opt out of certain tracking technologies. However, disabling certain cookies may limit the functionality of the Platform.
The Platform is not intended for use by anyone under the age of eighteen (18). We do not knowingly collect, solicit, or maintain personal information from children under 18 years of age. If we learn that we have collected personal information from a child under 18, we will promptly delete such information. If you are a parent or guardian and believe that your child has provided personal information to us, please contact us at privacy@bluevalleyjunk.com so that we can take appropriate action. We comply with the Children's Online Privacy Protection Act (COPPA) and all applicable laws regarding the protection of children's privacy.
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). These rights include: (a) the right to know what personal information we have collected about you, the categories of sources from which we collected it, the business or commercial purposes for collecting or selling it, and the categories of third parties with whom we share it; (b) the right to request deletion of your personal information, subject to certain exceptions; (c) the right to correct inaccurate personal information; (d) the right to opt out of the sale or sharing of your personal information (we do not sell personal information); (e) the right to limit the use of your sensitive personal information to purposes necessary to provide the services; and (f) the right not to be discriminated against for exercising any of these rights. If you are a Virginia resident, you have rights under the Virginia Consumer Data Protection Act (VCDPA). These rights include: (a) the right to confirm whether we are processing your personal data and to access such data; (b) the right to correct inaccuracies in your personal data; (c) the right to delete your personal data; (d) the right to obtain a portable copy of your personal data in a readily usable format; (e) the right to opt out of the processing of your personal data for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects; and (f) the right to appeal our decision regarding a consumer rights request. If we decline your request, you may appeal our decision by contacting us, and we will respond to your appeal within sixty (60) days. If your appeal is denied, you may contact the Virginia Attorney General's office to submit a complaint.
Some web browsers transmit "Do Not Track" (DNT) signals to websites and online services. There is currently no universally accepted standard for how companies should respond to DNT signals. At this time, the Platform does not respond to or honor DNT signals or similar mechanisms transmitted by web browsers. However, you may use the controls described in Section 6 (Cookies and Tracking Technologies) and our Cookie Policy to manage your tracking preferences.
The Platform may contain links to third-party websites, applications, and services that are not owned or controlled by Blue Valley Junk. This Privacy Policy does not apply to third-party websites or services. We are not responsible for the privacy practices, content, security, or data handling of any third-party websites or services. We encourage you to read the privacy policies of any third-party websites or services that you visit or use. The inclusion of any link on the Platform does not imply endorsement, recommendation, or approval by Blue Valley Junk.
In the event of a data breach that compromises the security, confidentiality, or integrity of your personal information, we will: (a) investigate the breach promptly and take reasonable steps to contain and remediate it; (b) notify affected individuals in accordance with applicable state and federal breach notification laws, including the Virginia breach notification statute (Va. Code section 18.2-186.6); (c) provide notification without unreasonable delay, and in no event later than sixty (60) days after discovery of the breach (or sooner if required by applicable law); (d) include in the notification a description of the breach, the types of information involved, the steps we are taking to address the breach, and recommendations for affected individuals; and (e) notify the Virginia Attorney General's office and any other applicable regulatory authorities as required by law. Notification may be provided by email, postal mail, telephone, or conspicuous posting on the Platform, as appropriate under the circumstances.
Depending on your jurisdiction, you may have the following rights regarding your personal information: (a) Access: you may request a copy of the personal information we hold about you; (b) Correction: you may request that we correct inaccurate or incomplete personal information; (c) Deletion: you may request that we delete your personal information, which will initiate a thirty (30) day grace period before permanent deletion occurs (see Section 4 for details), subject to certain exceptions required by law; (d) Portability: you may request a copy of your personal information in a structured, commonly used, and machine-readable format; (e) Opt-Out: you may opt out of promotional communications by clicking the "unsubscribe" link in any email, updating your notification preferences in your account settings, or contacting us at privacy@bluevalleyjunk.com; (f) Restriction: you may request that we restrict the processing of your personal information in certain circumstances; and (g) Objection: you may object to the processing of your personal information in certain circumstances. The Platform is operated from the United States. If you access the Platform from outside the United States, please be aware that your personal information may be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country of residence. By using the Platform, you consent to the transfer, storage, and processing of your information in the United States. We take reasonable steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it.
We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make changes, we will update the "Last updated" date at the top of this page. If we make material changes, we may provide additional notice through the Platform, by email, or by other means.
