DMCA / Copyright Policy

1. Overview

Blue Valley Junk, LLC ("Blue Valley Junk," "we," "us," or "our") respects the intellectual property rights of others and expects all users of our platform to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), Title 17, United States Code, Section 512, we will respond promptly to claims of copyright infringement committed using or through our platform (located at bluevalleyjunk.com).

This policy explains how to submit a notification of claimed copyright infringement (a "DMCA takedown notice"), how to submit a counter-notification if your content was removed, and our policy regarding repeat infringers.

2. Notification of Claimed Infringement

If you believe that content hosted on, stored on, or accessible through the Blue Valley Junk platform infringes upon your copyright, please submit a written DMCA takedown notice to our designated agent (identified below) containing the information outlined in Section 3 of this policy.

Upon receipt of a valid and complete DMCA takedown notice, we will act expeditiously to remove or disable access to the allegedly infringing material. We will also take reasonable steps to notify the user who posted or uploaded the allegedly infringing content so that they may submit a counter-notification if they believe the removal was made in error.

3. Required Information for a Valid DMCA Notice

To be effective under the DMCA, your takedown notice must be a written communication provided to our designated agent that includes substantially the following (as required by 17 U.S.C. Section 512(c)(3)):

  1. Identification of the copyrighted work: A description of the copyrighted work or works that you claim have been infringed. If multiple copyrighted works on our platform are covered by a single notification, you may provide a representative list of such works.
  2. Identification of the infringing material: A description of the material that you claim is infringing and that you want removed or disabled, along with information reasonably sufficient to permit us to locate the material on our platform. Please provide the specific URL(s) or other identifying information for each item of content you wish to have removed.
  3. Contact information: Your name, mailing address, telephone number, and email address, so that we may contact you regarding your notification.
  4. Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy and authority statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Signature:A physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf.

For the fastest response, please submit your DMCA takedown notice via email. Notices sent to other email addresses or through other channels may not receive a timely response.

5. Counter-Notification Process

If you believe that your content was removed or disabled as a result of mistake or misidentification of the material, you may submit a written counter-notification to our designated agent. Your counter-notification must include substantially the following (as required by 17 U.S.C. Section 512(g)(3)):

  1. Identification of the removed material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  2. Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if you are located outside the United States, the Western District of Virginia), and that you will accept service of process from the person who provided notification of the alleged infringement or an agent of such person.
  4. Contact information: Your name, mailing address, telephone number, and email address.
  5. Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will promptly forward a copy to the original complaining party. If the original complaining party does not file a court action seeking a restraining order against the content provider within ten (10) to fourteen (14) business days after receiving the counter-notification, we will restore or re-enable access to the removed material.

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Blue Valley Junk has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to our platform and terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

A user may be considered a repeat infringer if they have been the subject of more than one valid DMCA takedown notice. Blue Valley Junk reserves the right to determine what constitutes repeat infringement and to take action accordingly, including account suspension or permanent termination.

7. Good Faith Requirement

Please be aware that under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, the copyright owner or its licensee, or the service provider.

Before submitting a DMCA takedown notice, please carefully consider whether the use of the copyrighted material at issue may constitute fair use under 17 U.S.C. Section 107. If you are not sure whether the content you are reporting infringes your copyright, you may want to consult with an attorney before filing a notice.

8. User-Generated Content

Users of the Blue Valley Junk platform may upload, post, or submit content including photos, descriptions, reviews, and other materials. By uploading or submitting content to the platform, each user represents and warrants that they own or have obtained all necessary rights, licenses, consents, and permissions to use and authorize us to use such content, and that the content does not infringe, violate, or misappropriate any third party's intellectual property rights, publicity rights, privacy rights, or other rights.

Users who upload infringing content are solely responsible for any legal consequences arising from such uploads. Blue Valley Junk does not pre-screen user-generated content and cannot guarantee that all content on the platform is free from infringement.

9. Modifications to This Policy

Blue Valley Junk reserves the right to modify, amend, or update this DMCA / Copyright Policy at any time, in our sole discretion. Any changes will be effective immediately upon posting the revised policy on this page with an updated "Last updated" date. Your continued use of the platform after any changes constitutes your acceptance of the revised policy. We encourage you to review this policy periodically for any updates.
