Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Blue Valley Junk website, mobile application, and marketplace platform at bluevalleyjunk.com (collectively, the "Platform"). This AUP is incorporated into and forms part of our Terms of Service. By accessing or using the Platform, you agree to comply with this AUP. Violations of this AUP may result in immediate suspension or termination of your account, forfeiture of escrowed funds, and legal action.

1. General Conduct Standards

All users of the Platform are expected to: (a) act honestly, ethically, and in good faith in all interactions and transactions; (b) treat all other users, Blue Valley Junk staff, and third parties with respect and professionalism; (c) provide accurate, truthful, and complete information in all listings, bids, profiles, reviews, communications, and submissions; (d) comply with all applicable federal, state, and local laws, regulations, and ordinances; (e) honor all commitments, agreements, and obligations entered into through the Platform; (f) use the Platform only for its intended purpose of connecting Customers with Haulers for junk removal and related services; and (g) promptly report any violations of this AUP, suspicious activity, safety concerns, or illegal conduct to Blue Valley Junk at legal@bluevalleyjunk.com.

2. Prohibited Activities: Fraud and Deception

The following fraudulent and deceptive activities are strictly prohibited: (a) creating fake or misleading accounts, profiles, or identities; (b) impersonating any person, business, or entity, or falsely claiming an affiliation with any person, business, or entity; (c) submitting false, misleading, fraudulent, or deceptive job listings, bids, quotes, or estimates; (d) submitting fake, purchased, or incentivized reviews or ratings; (e) manipulating reviews, ratings, or search rankings through fraudulent means; (f) using the Platform to conduct phishing, scams, confidence schemes, or other fraudulent activities; (g) providing false or misleading insurance, licensing, or certification information; (h) misrepresenting the scope, nature, or quality of services provided or to be provided; (i) circumventing, bypassing, or attempting to circumvent or bypass the Platform's payment system, escrow system, or fee structure, including soliciting or accepting off-platform payments for jobs initiated on the Platform; (j) filing false or fraudulent disputes, claims, or chargebacks; (k) creating multiple accounts to manipulate the Platform, avoid enforcement actions, or circumvent restrictions; and (l) engaging in any other form of fraud, deception, or dishonesty in connection with the Platform.

3. Prohibited Activities: Harassment and Discrimination

The following activities related to harassment and discrimination are strictly prohibited: (a) harassing, threatening, intimidating, bullying, or stalking any user or any person through or in connection with the Platform; (b) using abusive, vulgar, profane, hateful, or threatening language in any communication, review, listing, or submission; (c) discriminating against any user or any person based on race, color, ethnicity, national origin, ancestry, religion, creed, sex, gender, gender identity, gender expression, sexual orientation, age, disability, medical condition, genetic information, marital status, familial status, veteran status, military status, citizenship status, socioeconomic status, or any other characteristic protected by applicable law; (d) refusing to provide or accept services based on any protected characteristic; (e) engaging in sexual harassment, unwelcome sexual advances, or sexually explicit conduct; (f) publishing, posting, or sharing private or personal information about another person without their consent (doxxing); (g) retaliating against any user who has filed a complaint, dispute, or report; and (h) encouraging or inciting others to engage in any of the foregoing activities.

4. Prohibited Activities: Illegal Conduct

The following illegal activities are strictly prohibited: (a) using the Platform for any purpose that violates any applicable federal, state, or local law, regulation, or ordinance; (b) illegally dumping, abandoning, or improperly disposing of any items, materials, waste, or substances; (c) transporting, handling, storing, or disposing of hazardous materials, toxic substances, medical waste, radioactive materials, asbestos-containing materials, or other regulated substances without proper licensing, certification, permits, and safety equipment; (d) theft, misappropriation, or unauthorized taking of any property, items, or materials; (e) property damage, vandalism, or destruction of property; (f) trespassing on private property or entering restricted areas without authorization; (g) violating environmental laws and regulations, including illegal discharge of pollutants, improper waste handling, and contamination of soil, water, or air; (h) violating transportation laws and regulations, including weight restrictions, load securement requirements, and commercial vehicle regulations; (i) operating vehicles or equipment under the influence of alcohol, drugs, or other impairing substances; (j) engaging in activities that endanger the health or safety of any person; (k) money laundering, tax evasion, or other financial crimes; (l) violating intellectual property rights, including copyright infringement, trademark infringement, and trade secret misappropriation; and (m) any other illegal activity in connection with the Platform.

5. Prohibited Activities: Platform Abuse

The following activities related to platform abuse are strictly prohibited: (a) interfering with, disrupting, or attempting to interfere with or disrupt the Platform, servers, networks, or infrastructure; (b) attempting to gain unauthorized access to any account, system, network, server, or data associated with the Platform; (c) using automated scripts, bots, scrapers, crawlers, spiders, or other automated means to access, interact with, collect data from, or monitor the Platform without our prior written consent; (d) reverse engineering, decompiling, disassembling, or attempting to derive the source code, algorithms, or architecture of the Platform; (e) transmitting viruses, malware, worms, trojans, ransomware, spyware, or other harmful or malicious code; (f) overwhelming, flooding, or overloading the Platform with excessive requests, data, or traffic (denial-of-service attacks); (g) probing, scanning, or testing the vulnerability of the Platform or any associated system or network; (h) bypassing, circumventing, disabling, or interfering with any security features, access controls, or usage limits of the Platform; (i) collecting, harvesting, scraping, or storing personal information, email addresses, or other data of other users without their consent; (j) using the Platform to send spam, unsolicited commercial messages, chain letters, pyramid schemes, or bulk communications; (k) manipulating or interfering with the Platform's search, ranking, or recommendation systems; and (l) sublicensing, reselling, renting, leasing, or otherwise commercially exploiting access to the Platform without our prior written consent.

6. Content Standards

All content submitted to the Platform, including but not limited to job listings, bids, reviews, ratings, messages, photographs, profile information, and other materials ("User Content"), must comply with the following standards: (a) User Content must be accurate, truthful, and not misleading; (b) User Content must not infringe or violate any intellectual property rights, including copyrights, trademarks, patents, trade secrets, or rights of publicity or privacy; (c) User Content must not contain any material that is defamatory, libelous, slanderous, or injurious to the reputation of any person or entity; (d) User Content must not contain any material that is obscene, pornographic, sexually explicit, or inappropriate; (e) User Content must not contain any material that promotes or glorifies violence, hatred, terrorism, self-harm, or illegal activity; (f) User Content must not contain any personal, private, or confidential information about any third party without their consent; (g) User Content must not contain any spam, advertisements, solicitations, or promotional materials unrelated to the Platform's services; (h) User Content must not contain any viruses, malware, or other harmful code; and (i) User Content must comply with all applicable laws and regulations. Blue Valley Junk reserves the right, but has no obligation, to review, monitor, edit, remove, or disable access to any User Content at any time, for any reason, in its sole discretion.

7. Hauler-Specific Obligations

In addition to the general conduct standards and prohibitions above, Haulers must: (a) maintain all required licenses, permits, and registrations in good standing at all times; (b) maintain adequate insurance coverage at all times, including general liability and commercial auto insurance; (c) perform all services in a safe, professional, and workmanlike manner; (d) dispose of all items and materials in compliance with all applicable environmental laws and regulations; (e) not subcontract or delegate work to any person who does not meet the Platform's requirements; (f) promptly communicate with Customers regarding scheduling, scope of work, and any issues that arise; (g) not make false or misleading claims about qualifications, experience, certifications, or capabilities; (h) protect Customer property and premises from unnecessary damage during the performance of services; (i) clean up the work area upon completion of services; and (j) comply with all applicable occupational safety and health regulations.

8. Enforcement Actions

Blue Valley Junk reserves the right, in its sole and absolute discretion, to take any of the following enforcement actions for violations of this AUP, our Terms of Service, or any other applicable policy: (a) issuing a warning or notice of violation; (b) removing, editing, or disabling access to any content that violates this AUP; (c) temporarily suspending your account for a specified or indefinite period; (d) permanently terminating your account and prohibiting you from creating new accounts; (e) forfeiting any escrowed funds associated with transactions involved in or affected by the violation; (f) withholding, delaying, or reversing payments; (g) reporting violations to law enforcement, regulatory agencies, or other appropriate authorities; (h) pursuing legal action, including claims for damages, injunctive relief, and recovery of costs and attorneys' fees; and (i) taking any other action we deem necessary or appropriate to address the violation and protect the Platform, our users, and the public. Blue Valley Junk may take enforcement action with or without prior notice to you, depending on the severity and nature of the violation. The decision to take enforcement action, and the specific action taken, is entirely within Blue Valley Junk's sole discretion and shall not give rise to any liability on the part of Blue Valley Junk.

9. Reporting Violations

If you become aware of any violation of this AUP, any illegal activity, any safety concern, or any other conduct that you believe is harmful, fraudulent, or inappropriate, please report it to us immediately at legal@bluevalleyjunk.com. When reporting a violation, please include as much detail as possible, including: (a) your name and contact information; (b) the name or username of the user involved in the violation; (c) a description of the violation, including the date, time, and location if applicable; (d) any evidence supporting your report, including screenshots, photographs, messages, or documents; and (e) any other relevant information. Blue Valley Junk will review all reports and take appropriate action in its sole discretion. Blue Valley Junk will not retaliate against any user who reports a violation in good faith. However, submitting false, malicious, or bad-faith reports is itself a violation of this AUP and may result in enforcement action.

10. Cooperation with Investigations

You agree to cooperate fully with Blue Valley Junk in any investigation of suspected violations of this AUP, including providing information, documents, and access as reasonably requested. You also agree to cooperate with law enforcement, regulatory agencies, and other authorities in connection with any investigation of illegal activity or violations of applicable law conducted through or in connection with the Platform.

11. Changes to This Policy

Blue Valley Junk reserves the right to modify, amend, or update this Acceptable Use Policy at any time, in its sole discretion, by posting the revised policy on the Platform with an updated "Last updated" date. Your continued use of the Platform after any changes constitutes your acceptance of the revised policy.
