By accessing or using the Platform, you acknowledge that you have read, understood, and agree to these disclaimers. These disclaimers supplement and are incorporated into our Terms of Service.
Blue Valley Junk, LLC ("Blue Valley Junk," "we," "us," or "our") operates a technology platform and marketplace that connects customers with independent haulers. Blue Valley Junk is NOT a junk removal company, hauling company, waste management company, environmental services company, or service provider of any kind. We do not perform, provide, supervise, direct, or guarantee any junk removal, hauling, transportation, disposal, cleaning, or related services. All services advertised or offered on the Platform are provided solely by independent third-party Haulers who are not employees, agents, representatives, or affiliates of Blue Valley Junk. Blue Valley Junk makes no representations or warranties regarding the quality, safety, legality, timeliness, reliability, or suitability of any services, Haulers, or transactions on the Platform. Your use of the Platform and any reliance on information, content, reviews, ratings, or other materials available on the Platform is entirely at your own risk.
Nothing on the Platform constitutes, or is intended to constitute, professional advice of any kind. Without limitation, the Platform does not provide: (a) legal advice regarding contracts, liability, property rights, zoning, permits, environmental regulations, employment law, or any other legal matter; (b) financial or tax advice regarding income, deductions, tax obligations, business structure, or any other financial matter; (c) environmental advice regarding waste classification, disposal requirements, hazardous material identification, contamination assessment, remediation, or any other environmental matter; (d) insurance advice regarding coverage requirements, policy selection, risk assessment, or any other insurance matter; (e) construction or engineering advice regarding structural integrity, load-bearing capacity, demolition procedures, or any other construction or engineering matter; or (f) safety advice regarding personal protective equipment, hazard mitigation, occupational safety, or any other safety matter. You should consult with qualified licensed professionals before making any decisions based on information obtained through the Platform. Blue Valley Junk expressly disclaims any liability arising from your reliance on any information provided on or through the Platform as a substitute for professional advice.
Blue Valley Junk makes no representations, warranties, or guarantees regarding the amount of income, revenue, earnings, or profit that any Hauler may achieve through the Platform. Any statements, examples, testimonials, or case studies regarding earnings or income are for illustrative purposes only and should not be construed as a guarantee or promise of similar results. Actual earnings depend on numerous factors outside Blue Valley Junk's control, including but not limited to: (a) the Hauler's location, service area, and local market conditions; (b) the Hauler's experience, skills, equipment, and business practices; (c) the Hauler's availability, pricing, and responsiveness; (d) customer demand, seasonality, and economic conditions; (e) competition from other Haulers and service providers; (f) the Hauler's reviews, ratings, and reputation; and (g) numerous other factors. Blue Valley Junk does not guarantee that Haulers will receive any jobs, bids, bookings, or income through the Platform. Haulers are solely responsible for their own business success or failure.
Reviews, ratings, testimonials, feedback, and other user-generated content on the Platform represent the personal opinions and experiences of individual users. Blue Valley Junk does not verify, validate, authenticate, investigate, or guarantee the accuracy, truthfulness, completeness, or reliability of any reviews, ratings, or user-generated content. Reviews may not be representative of the typical experience with a particular Hauler or the Platform. Blue Valley Junk does not edit, filter, or modify the content of reviews (other than for removal of prohibited content as described in our Acceptable Use Policy). The presence of reviews on the Platform does not constitute an endorsement, recommendation, or approval of any Hauler, Customer, or service. You should not rely solely on reviews when making decisions about engaging a Hauler or using the Platform. Blue Valley Junk is not responsible for any decisions you make based on reviews or ratings on the Platform.
Blue Valley Junk is NOT responsible for the disposal, recycling, donation, or handling of any items, materials, waste, or substances removed by Haulers through the Platform. All disposal and handling decisions are made solely by the independent Haulers. Blue Valley Junk does not direct, supervise, or control how Haulers dispose of items. Blue Valley Junk does not guarantee that any items will be disposed of, recycled, donated, or handled in compliance with any federal, state, or local environmental laws, regulations, or ordinances, including but not limited to the Resource Conservation and Recovery Act (RCRA), Clean Water Act, Clean Air Act, Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA/Superfund), Toxic Substances Control Act (TSCA), Virginia Waste Management Act, or any local waste disposal ordinances. Blue Valley Junk is not liable for any environmental contamination, pollution, illegal dumping, improper disposal, hazardous material exposure, soil contamination, groundwater contamination, air pollution, or any other environmental harm caused by or resulting from the actions or omissions of any Hauler. Customers and Haulers are each independently responsible for ensuring compliance with all applicable environmental laws and regulations.
All prices, bids, quotes, estimates, and fees displayed on the Platform are set exclusively by individual Haulers. Blue Valley Junk does not set, suggest, mandate, control, or influence the prices charged by Haulers. Prices may vary significantly between Haulers based on numerous factors, including location, scope of work, difficulty, equipment requirements, disposal costs, and individual business considerations. Blue Valley Junk does not guarantee that any price or bid is fair, reasonable, competitive, or accurate. Estimates and quotes provided through the Platform are subject to change based on the actual scope of work, site conditions, and other factors that may not be apparent from the initial job listing. You are responsible for reviewing and agreeing to prices directly with the Hauler before work begins. Blue Valley Junk is not responsible for any pricing disputes between Customers and Haulers.
Blue Valley Junk does not guarantee the availability of the Platform, any Haulers, or any services at any time. The Platform may be unavailable due to maintenance, technical issues, server downtime, internet connectivity problems, force majeure events, or other factors beyond our control. Hauler availability is determined solely by individual Haulers and may vary based on their schedule, capacity, location, and personal decisions. Blue Valley Junk does not guarantee that Customers will receive bids, that Haulers will be available in any particular area, or that any job can be completed within any particular timeframe. Blue Valley Junk is not responsible for any loss, damage, inconvenience, or harm resulting from Platform unavailability or Hauler unavailability.
Photographs, images, videos, graphics, and other visual media displayed on the Platform, including but not limited to Hauler profile photos, job listing photos, before-and-after photos, and marketing materials, are for illustrative purposes only and may not accurately represent actual conditions, results, services, or outcomes. Photos may have been taken under different conditions, at different locations, or at different times than the services being offered. User-submitted photos have not been verified, authenticated, or endorsed by Blue Valley Junk. Before-and-after photos are provided by individual Haulers and may not be representative of typical results. Blue Valley Junk does not guarantee that the actual results of any junk removal service will match or resemble any photographs displayed on the Platform. Blue Valley Junk is not responsible for any discrepancy between photographs and actual conditions, services, or results.
The Platform may contain content, links, advertisements, and materials provided by third parties, including Hauler profiles, customer reviews, job listings, and external website links. Blue Valley Junk does not control, endorse, sponsor, recommend, or assume any responsibility for any third-party content. The inclusion of third-party content on the Platform does not constitute an endorsement, recommendation, or approval by Blue Valley Junk. You access and use third-party content at your own risk. Blue Valley Junk is not responsible for the accuracy, completeness, legality, reliability, or availability of any third-party content.
Blue Valley Junk does not guarantee any particular outcome, result, or level of satisfaction from using the Platform or from any transaction facilitated through the Platform. The Platform is provided as a tool to connect Customers and Haulers, and all outcomes depend on factors entirely outside Blue Valley Junk's control. Blue Valley Junk does not guarantee that: (a) you will find a Hauler suitable for your needs; (b) any Hauler will perform services to your satisfaction; (c) any job will be completed on time, on budget, or as described; (d) any items will be properly disposed of, recycled, or donated; (e) your property will not be damaged during the performance of services; or (f) any dispute will be resolved to your satisfaction.
To the maximum extent permitted by law, Blue Valley Junk disclaims all liability arising from your reliance on any information, content, reviews, ratings, photographs, estimates, or other materials on the Platform. Blue Valley Junk implements industry-standard security measures including HTTPS encryption, bcrypt password hashing, AES-256-GCM encryption for sensitive data, and PCI-compliant payment processing through Stripe. However, no system is completely secure. Blue Valley Junk is not responsible for unauthorized access to user accounts resulting from user negligence (weak passwords, shared credentials, phishing). Users are responsible for maintaining the security of their own accounts and devices. You acknowledge that data transmitted over the internet may be subject to interception by third parties, and that no security measures can provide absolute protection against all threats.
Blue Valley Junk does not provide, verify, or guarantee insurance coverage for any hauler on the platform. The "Insurance Verified" badge displayed on hauler profiles indicates self-reported coverage and has not been independently verified by Blue Valley Junk. Blue Valley Junk has not reviewed, confirmed, or validated any insurance documentation, policy status, coverage limits, or claims history for any hauler. Customers should independently verify hauler insurance before allowing work on their property by requesting certificates of insurance directly from the hauler and confirming coverage with the insurance carrier. Blue Valley Junk provides 1099-NEC tax reporting as required by law. However, Blue Valley Junk does not provide tax advice. Haulers are solely responsible for understanding and complying with all federal, state, and local tax obligations, including but not limited to income taxes, self-employment taxes, sales taxes, and estimated quarterly tax payments. Nothing on the Platform constitutes tax advice or should be relied upon as such. Consult a qualified tax professional for advice specific to your situation. Blue Valley Junk makes no representations or warranties regarding the tax implications of any transaction on the Platform.
IN NO EVENT SHALL BLUE VALLEY JUNK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF BLUE VALLEY JUNK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION APPLIES TO ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM, INCLUDING BUT NOT LIMITED TO CLAIMS RELATED TO HAULER CONDUCT, SERVICE QUALITY, PROPERTY DAMAGE, PERSONAL INJURY, DATA SECURITY, AND PAYMENT PROCESSING. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Any cause of action or claim arising out of or relating to these disclaimers, the Terms of Service, or the Platform must be commenced within one (1) year after the cause of action accrues. Otherwise, such cause of action or claim is permanently barred. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise. You agree that this shortened statute of limitations is reasonable and that you waive any statute of limitations that would otherwise provide a longer period to bring a claim.
